Limitation period in consumer protection act

Various applications and petitions before the Consumer Commission have to be filed within the period specified below. However, the Commission can condone the delay if valid and sufficient reasons to its satisfaction are given. Valid and sufficient reasons can differ from case-to-case basis but it has to be a satisfactory reason.

FILING OF CONSUMER COMPLAINT

A complaint has to be filed within two (2) years from the date on which the cause of action has arisen.

APPEAL

An appeal to State Commission from an order of the District Commission has to be filed within forty-five (45) days from the date of the order. An appeal to the Supreme Court or the National Commission from an order of the National Commission or the State Commission respectively has to be filed within thirty (30) days from the date of the order.

REVISION PETITION

A revision Petition has to be filed within ninety (90) days from the date of receipt of certified copy of the order.

REVIEW APPLICATION

An application for review to the Consumer Commission has to be filed within thirty (30) days from the date of the order.

ANY OTHER APPLICATION

Any other application has to be filed within thirty (30) days from the date of the cause of action or the date of knowledge.
